1.  File the Petition to Rescind the Statutory Summary Suspension today!

  • The best chance we can give our clients when they face a suspension for DUI in Illinois is to file the Petition to Rescind the Statutory Summary Suspension the same day they hire us.  Illinois law states that a driver's license will be suspended on the 46th day following a DUI arrest.  That clock works against the defendant.  By filing a motion to beat the suspension as early as the same day of arrest, we start a 30 day clock that ticks against the State.  If they don't give our client a hearing within 30 days after we file the motion or the first court date, the Secretary of State cannot suspend your driver's license!  

2.  Send out subpoenas to protect evidence.

  • The next step is to issue subpoenas for important evidence such as video and audio tapes, as well as police reports and a Notice of Discovery.  If the State does not comply with our subpoenas by bringing the requested items into court, many judges will not allow a suspension hearing to proceed.

3.  Force the State's 30 clock to expire.

  • Important.  Important. Important.  It is established through case law that if the State can not give a hearing to a DUI client within 30 days from the date we filed our demand for hearing (or the first court date), they will not be allowed to suspend your driver's license.  No Monitoring Device Driver's Permit (MDDP).  No suspension.  No mandatory 30 days hard time on the suspension with no relief.  When successful, the suspension is lifted and completely removed from your driving record.
